Personal Data Processing Rules
The personal data administrator is LM PAY S.A., based in Warsaw (Lechicka 23a, 02-156 Warsaw; hereinafter Administrator). You can contact the Administrator via email at iod@lmpay.pl or at the above address.
Personal data is processed for the purpose of conducting recruitment and selecting the right person for employment, including assessing the candidate's qualifications, abilities, and skills, and in the case of additional consent – also for the purpose of recruitment for other job positions.
The legal basis for processing personal data is:
in the case of recruitment for an employment contract: within the scope resulting from Article 22(1) of the Labor Code – our legal obligation (Article 6(1)(c) of the GDPR), and in the case of providing personal data beyond what is specified in labor law, the legal basis for processing is consent (Article 6(1)(a) of the GDPR). We do not require the provision of such data, but we treat their provision as equivalent to giving consent for processing;
in the case of recruitment for a civil law contract: the necessity of data processing to conclude a civil law contract (Article 6(1)(b) of the GDPR); in other cases, the legal basis for processing is consent (Article 6(1)(a) of the GDPR). We do not require the provision of such data, but we treat their provision as equivalent to giving consent for processing;
in the case of recruitment for similar positions: the legal basis for processing personal data is consent to participate in such recruitment, as well as the grounds specified in points 1 and 2 above, depending on the type of contract that may be concluded as a result of such recruitment (Article 6(1)(a) of the GDPR).
Recipients of personal data are entities providing services to the Administrator (e.g., hosting providers, IT services, and technical support) that need access to data to perform their duties. These entities will only have access to the data to the extent necessary to fulfill their tasks.
Personal data will be stored until the end of the recruitment process for which they were collected or until consent is withdrawn (whichever comes first).
You have the right to:
request access to your personal data, rectification, deletion, or restriction of processing, or the right to object to processing, as well as the right to data portability,
withdraw any consent given at any time without affecting the lawfulness of processing based on consent before its withdrawal,
file a complaint with the supervisory authority, i.e., the President of the Personal Data Protection Office.
In the case of recruitment for an employment contract, providing data within the scope resulting from Article 22(1) of the Labor Code is a condition for participation in the current recruitment process, and failure to provide data will result in the inability to participate; providing other data is voluntary. In the case of recruitment for a civil law contract, providing data is voluntary, and failure to provide data will result in the inability to participate in the recruitment and to conclude such a contract.
Personal data will not be used for automated decision-making, including profiling.
